Viktor filed a lawsuit to legally divide the shared property and legalize outbuildings without discussing it with Diana beforehand.
The lawsuit coincided with the tragic death of Diana's husband in the war. This led her to suspect that Viktor was intentionally exploiting her vulnerable state to seize a portion of the land for which documents were not yet finalized.
The situation escalated critically due to a breakdown in the electrical panel. Diana was left without electricity for several days, suffered financial losses (spoiled food, forced purchase of an EcoFlow power station, and grid reconnection). She believed Viktor cut the power intentionally and called the police.
Parties' Positions:
Diana's Position: Demanded that Viktor reimburse 125,000 UAH for material damages and an additional moral compensation (around 200,000 UAH).
Viktor's Position: Explained that the lawsuit was filed strictly on his lawyer's advice to regularize documents, with no malicious intent. He admitted knowing about the blown fuse but did not warn Diana due to their already tense relationship. Viktor agreed to compensate for material damages but categorically refused to pay for moral damages due to mutual insults from Diana directed at his family.
Resolution Process and Results:
Through the professional guidance of the mediator, the parties were able to clarify each other's true motives. Diana realized that Viktor's lawsuit was a standard legal procedure, not a planned attack. As a result of the joint session, the following agreements were reached:
Diana completely dropped her claims for moral damages.
The parties agreed on a material compensation amount of 125,000 UAH.
A strict cash payment schedule was approved in three installments (45,000 UAH, 40,000 UAH, and 40,000 UAH at one-month intervals).
The parties agreed to document the cash transfers with written receipts and to finalize the agreement based on the mediation results without additional notarization.
